3rd Circ. Lets HHS Off Hook For Pa. Disability Costs

Law360, New York (June 13, 2011, 4:13 PM EDT) -- The Third Circuit ruled Monday that the U.S. Department of Health and Human Services does not have to reimburse the Pennsylvania Public Welfare Department under the federal Medicaid program for occupancy costs at community residential facilities for the developmentally disabled.

In a precedential decision affirming the district court's “well-reasoned decision,” a three-judge panel concluded HHS was not obligated to cover the disputed costs under an exception to a federal financial participation statute that releases the government from having to reimburse states for room and board costs...
