Class Settlement Rejected In Compressor Antitrust MDL

Law360, New York (June 13, 2011, 10:53 PM EDT) -- A Michigan federal judge ruled Monday that a class action settlement with Tecumseh Products Co. over an alleged price-fixing conspiracy failed because the direct purchaser plaintiffs had not established whether they bought refrigerant compressors directly from the defendants.

U.S. District Judge Sean F. Cox said the plaintiffs did not meet the requirements for settlement-only class certification because the proposed class included people who failed to allege they purchased compressors from the defendants and therefore had no standing to assert federal antitrust claims.
