Home Health Care Workers Fight For Overtime

Law360 (May 18, 2007, 12:00 AM EDT) -- As the U.S. Supreme Court mulls arguments in a case for overtime compensation to home health care workers, lawyers in Indiana have filed a collective action arguing the employee group is not exempt under federal law.

The action, filed Wednesday in the U.S. District Court for the Southern District of Indiana, claims Indiana-based Advantage Home Health Care Inc. unlawfully classified its workers as exempt from time-and-a-half payments under the Fair Labor Standards Act.
