Award Upped To $92M In DOE Spent Fuel Removal Suit

Law360, New York (June 14, 2011, 3:16 PM EDT) -- A federal judge awarded two Progress Energy Inc. units nearly $92 million in damages Tuesday in their suit claiming the U.S. government breached a contract to collect spent nuclear fuel from power plants they operate in the Carolinas and Florida.

Circuit Judge Thomas Wheeler of the U.S. Court of Federal Claims ruled that under a new model for calculating the $82.8 million in damages the court originally awarded in 2007, Carolina Power & Light Co. and Florida Power Corp. were entitled to recover $91.9 million....
