7th Circ. Revives Landfill Suit Against Trash Hauler

Law360, New York (June 14, 2011, 4:23 PM EDT) -- The Seventh Circuit on Tuesday overturned a decision allowing Waste Management of Ill. Inc. to go ahead with plans to build a landfill near St. Louis, saying bird watchers who oppose the project have standing to sue.

A three-judge panel ruled that a U.S. Army Corps of Engineers decision allowing WMI to destroy 18 acres of wetlands to build its North Milam recycling and disposal facility will have to face further scrutiny.
