Cuervo Broke Deal With Jim Beam: NY Appeals Court

Law360, New York (June 16, 2011, 2:52 PM EDT) -- The maker of Jose Cuervo-brand tequila breached an agreement with Jim Beam Brands Co. that restricted Cuervo's use of a crow trademark, a New York state appeals court ruled Thursday.

A lower court properly found that Tequila Cuervo La Rojena SA de CV is liable for the breach because it used the crow mark — which is similar to Jim Beam's mark — on materials not allowed by a 1997 deal, the Manhattan state appeals court ruled in a brief order.
