United Skycaps Win Conditional Cert. In Tip Suit

Law360, New York (June 17, 2011, 12:57 PM EDT) -- A Massachusetts federal judge granted conditional certification last week to a nationwide class of United Air Lines Inc. skycaps who claim that the airline's baggage fee policy cost them tips in violation of federal labor law.

U.S. District Judge Nancy Gertner conditionally certified the class on June 13, finding that the plaintiff had sufficiently alleged that the proposed class members were subject to a common policy, namely United's decision to require that skycaps pay $2 per bag out of their tips even when the customer did...
