Commerce Changes Nonmarket Dumping Calculations

Law360, New York (June 21, 2011, 9:41 PM EDT) -- The U.S. Department of Commerce on Tuesday announced changes to the way it will calculate the cost of labor in anti-dumping proceedings involving nonmarket economy countries in response to two recent court rulings that rejected previous policies.

In a Federal Register notice, Commerce said that from now on, it will no longer calculate labor costs for nonmarket economy countries by averaging the rates of several comparable market economy countries, but will instead use only data from the primary surrogate country.
