Fed. Circ. Sends Chinese Valve Duty Suit Back To CIT

Law360, New York (June 22, 2011, 7:47 PM EDT) -- The Federal Circuit on Wednesday partially overturned the U.S. Court of International Trade's decision to affirm anti-dumping duties on front-seating service valves from China imported by Zhejiang Dunan Hetian Metal Co. Ltd. and remanded the case to the lower court.

Dunan's appeal challenged the CIT's decision to back the U.S Department of Commerce on three issues: whether the agency improperly calculated the surrogate value for brass bar, whether Commerce applied an improper adverse inference to Dunan’s December 2007 sales data and whether Commerce’s valuation of labor...
