High Court Ends Anna Nicole Estate's Inheritance Bid

Law360, New York (June 23, 2011, 3:07 PM EDT) -- The U.S. Supreme Court on Thursday ended the saga of the late Anna Nicole Smith’s claim to oilman J. Howard Marshall II’s fortune, finding that a bankruptcy court lacked constitutional authority to decide that Marshall’s son robbed her of her inheritance.

With Justice Anthony Kennedy providing the swing vote, the high court concluded that while the bankruptcy court overseeing Smith's Chapter 11 case had statutory authority to rule on her tortious interference counterclaim against Pierce Marshall, it is not an Article III court and therefore exceeded...
