Marsh's Noncompete Is Enforceable: Texas High Court

Law360, New York (June 24, 2011, 8:45 PM EDT) -- The Texas Supreme Court on Friday found that a Marsh & McLennan Cos. Inc. unit's nonsolicitation agreement with an employee who was given stock options was enforceable in order to protect the company's goodwill.

In a 6-3 ruling, the state's high court overturned two lower court rulings in a case in which an insurance unit of Marsh sued former Managing Director Rex Cook, who resigned from the company to join a competitor after exercising his stock options, for breach of contract.
