Fed. Circ. Mostly OKs $37.6M Dairyland Nuke Waste Award

Law360, New York (June 24, 2011, 5:44 PM EDT) -- The Federal Circuit on Friday issued a precedential ruling that mostly affirmed a $37.6 million damages award for Wisconsin-based Dairyland Power Cooperative in its suit over the U.S. Department of Energy’s failure to fulfill a contract to store nuclear waste.

Both Dairyland and the U.S. government had been unsatisfied with the award granted by the U.S. Court of Federal Claims, which included $16.6 million for storage costs, $12 million for investment in a private storage facility and $6.1 million for overhead costs.
