St. Jude Wins Injunction, Verdict Trimmed By $1.3B
Law360, New York (June 24, 2011, 7:04 PM EDT) -- The California state judge overseeing a trade secrets case brought by a division of St. Jude Medical Inc. entered a default judgment Monday against Chinese competitor Nervicon Co. Ltd., issuing a permanent injunction but declining to adopt a jury's $1.3 billion advisory award against Nervicon.
"Because Nervicon did not appear in this matter and St. Jude took Nervicon's default, and because no specific amount of damages was prayed for in the first amended complaint, the court hereby limits the relief against Nervicon to injunctive relief," Judge Ruth A. Kwan wrote.
