Supreme Court Remands Sears False Ad Class Action

Law360, New York (June 27, 2011, 3:40 PM EDT) -- The U.S. Supreme Court vacated a ruling Monday in a deceptive marketing suit against Sears Roebuck & Co., asking the Seventh Circuit to reconsider its decision to block related class actions in light of a recent high court decision in a similar case.

The suit will be remanded to the Seventh Circuit, which enjoined Chicago attorney Clinton Krislov, who it called pugnacious and pertinacious to a fault, from filing any more class actions related to alleged problems with the way Sears advertises its stainless steel clothes...
