The DOJ's Revised Merger Remedies Guidelines

Law360, New York (June 28, 2011, 5:34 PM EDT) -- The Antitrust Division of the U.S. Department of Justice issued its anticipated revised Policy Guide to Merger Remedies (Remedies Guide) on June 17, 2011[1], which updates the Division’s original guidelines, which had been issued in 2004. The Remedies Guide restates much of the Division’s precedents for devising, implementing and enforcing remedy provisions and consent decrees in the merger context, albeit in a more formal, transparent and systematic form.[2]
