11th Circ. Revives Lockheed Race Bias Suit

Law360, New York (June 30, 2011, 4:46 PM EDT) -- Reviving a discrimination lawsuit against Lockheed Martin Corp., the Eleventh Circuit held on Thursday that summary judgment is not proper if there is circumstantial evidence that can raise the inference that an employer discriminated against an employee.

The appeals court vacated a Georgia federal court's decision to grant summary judgment to Lockheed in a Title VII suit lodged by white plant supervisor Anthony Mitten, who alleged that the company fired him because of his race.
