Asbestos Scheme Bros. To Be Resentenced: 2nd Circ.

Law360, New York (June 30, 2011, 4:05 PM EDT) -- The Second Circuit ruled Thursday that a New York federal judge improperly enhanced the prison sentences of two brothers who were convicted of committing fraud in order to carry out illegal asbestos removal work.

The appeals court remanded the case for resentencing after finding that U.S. District Judge Frederick Scullin Jr. relied on a too-high sentencing guideline range when imposing a 44-month prison sentence on attorney Steven Mancuso and a 78-month sentence on his brother Paul Mancuso.
