Texas Court Nixes $45M EcoProduct Suit Over Plant Woes

Law360, New York (June 30, 2011, 4:53 PM EDT) -- A Texas appeals court on Thursday affirmed a lower court decision to throw out EcoProduct Solutions LP's $45 million breach of contract and negligence suit against two contractors that built a chemical plant for the plaintiff.

The trial court was right to dismiss EcoProduct's suit against engineering firm Englobal Engineering Inc. and equipment maker Swenson Technology Inc., Texas' First District Court of Appeals said.
