Judge Dismisses ERISA Suit Against Aetna

Law360 (May 25, 2007, 12:00 AM EDT) -- A federal judge in Manhattan has tossed out an ERISA lawsuit against Aetna Life and Casualty Co. brought by a woman who asked the court for declaratory judgment saying that she was disabled and entitled to long term benefits under a policy issued to her former employer.

U.S. District Judge Paul A. Crotty issued a twelve-page opinion and order Thursday granting Aetna’s motion for summary judgment and dismissing plaintiff Debra Lee’s claims.
