DOC Erred On Vietnam Fish Duties: Exporter To Fed. Circ.

Law360, Washington (July 5, 2011, 4:36 PM EDT) -- Vietnamese seafood exporter QVD Food Co. Ltd. told the Federal Circuit on Tuesday that the U.S. Department of Commerce wrongly ignored a study that would have altered its anti-dumping duty determination for the company’s fish fillets in the company’s favor.

Commerce’s decision not to include the data from the study in its analysis was contrary to law, as the department is required to use the best possible information, QVD attorney Mark E. Pardo of Grunfeld Desiderio Lebowitz Silverman & Klestadt LLP told a three-judge panel....
