Essar Takes Steel Subsidies Case To Fed. Circ.

Law360, Washington (July 5, 2011, 5:50 PM EDT) -- Essar Steel Ltd. asked the Federal Circuit on Tuesday to overrule the U.S. Department of Commerce’s finding that Essar received a higher ad valorem government subsidy than it had previously found, saying Commerce included inaccurate delivery charges in its calculations.

In September, the U.S. Court of International Trade dismissed Essar’s suit taking issue with Commerce's subsidy ruling on steel products imported in 2006. Following its initial ruling, Commerce later issued a remand ruling with a less favorable subsidy finding for Essar, which Essar is currently contesting....
