DC Circ. Tosses Challenge To Yucca Mountain Retreat

Law360, New York (July 1, 2011, 6:19 PM EDT) -- The D.C. Circuit on Friday dismissed petitions by South Carolina, Washington state and others challenging the Obama administration's decision to pull the plug on the controversial Yucca Mountain nuclear waste repository in Nevada.

The petitioners, including Aiken County, S.C., and a group of Washington residents, argued that the federal government would neglect its duty to provide for the permanent disposal of all the nation's high-level radioactive waste if it followed through with plans to abandon Yucca Mountain, the only congressionally approved permanent nuclear dump site....
