Judge Trims BNSF Suit Over Calif. Solar Project

Law360, New York (July 5, 2011, 1:47 PM EDT) -- A federal judge on Thursday trimmed claims brought under state law, as well as claims against the California Energy Commission, from BNSF Railway Co.'s suit seeking to block the construction of a solar power plant in the Mojave Desert.

However, U.S. District Judge Stephen V. Wilson maintained federal law allegations against individual members of the commission over the Calico Solar Project, finding that those claims fell under an exception to sovereign immunity known as the Ex parte Young doctrine.
