EU Court Backs Designer In Trademark Row Over Name

Law360, New York (July 5, 2011, 4:54 PM EDT) -- The European Union's highest court ruled in favor of Italian fashion designer Elio Fiorucci on Tuesday in a trademark dispute with Japanese clothing company Edwin Co. Ltd., finding that he is entitled to prevent unauthorized use of his name as protection against economic exploitation.

The European Court of Justice decided that the concept of "right to a name" in Italian trademark regulation extended protection to economic benefits associated with Fiorucci's name.
