Xethanol Wants Securities Complaint Dismissed

Law360, New York (May 25, 2007, 12:00 AM EDT) -- The defendants in a consolidated securities suit against Xethanol Corp. filed a memorandum Thursday in support of their bid to have the case thrown out, arguing that the complaint fails to state a valid fraud claim under federal securities laws.

The 19-page memorandum seeks to bolster the defendants’ claim that the amended complaint against the ethanol research and production company filed by the plaintiffs in March should be dismissed in its entirety with no leave to re-plead.
