8th Circ. Affirms Class Cert. In Faulty Piping MDL

Law360, Los Angeles (July 6, 2011, 10:25 PM EDT) -- In a split decision Wednesday, the Eight Circuit affirmed certification of a class of homeowners accusing Zurn Industries LLC of negligence and breach of warranty for manufacturing allegedly faulty crimp fittings used in plumbing.

The ruling upholds a May 2010 decision by a Minnesota district judge to certify breach of express and implied warranty as well as negligent failure-to-warn claims in the multidistrict litigation.
