Law360, New York (July 11, 2011, 1:31 PM EDT) -- Zurich American Insurance Co. on Friday settled a suit in Georgia federal court in which it sought to avoid coverage for a $36.8 million contract dispute alleging Latex Construction Co. botched work on a natural gas pipeline running from Illinois to Indiana.
U.S. District Judge Timothy C. Batten dismissed the suit, noting that Zurich and Latex had agreed to drop the insurer's action seeking to avoid defending and indemnifying the pipeline fight. The parties also agreed to drop the construction company's counterclaims.
