Alatech Fired Up Over Rejected Condoms

Law360, New York (July 11, 2011, 3:03 PM EDT) -- Alatech Healthcare LLC accused the U.S. Agency for International Development on Friday in the U.S. Court of Federal Claims of violating a supply contract and a settlement agreement by unfairly rejecting more than 20 million of its condoms.

According to the complaint, USAID turned away Alatech's condoms because a testing facility detected black particles on the surface of the condoms, but Alatech claims the condoms would have been accepted had USAID not modified its inspection criteria midway through the contract performance.
