Deutsche Bahn Gets OK To Appeal Cartel Suit Cutoff

Law360, New York (July 11, 2011, 6:40 PM EDT) -- After overturning its own precedent for when the statute of limitations starts ticking in antitrust damages cases, the British competition appeals court ruled Monday that Deutsche Bahn AG can appeal the tribunal's decision to dismiss its cartel suit against Morgan Crucible Co. PLC.

The Competition Appeal Tribunal of the U.K. granted Deutsche Bahn’s request to take the dispute — which stems from Morgan Crucible’s alleged role in an 11-year-long carbon and graphite products cartel — to the country’s Court of Appeal.
