NY Fracking Rules Could Spur Local Legal Battles

Law360, New York (July 13, 2011, 9:29 PM EDT) -- New York state’s proposal to regulate hydraulic fracturing could give rise to a new spate of legal disputes over natural gas development in the Marcellus Shale, with prospective drillers and municipalities wrangling over local restrictions on the controversial extraction process. 

A provision in the regulations requiring drilling applicants to certify that their activities comply with local laws has the potential to spark litigation among drillers, towns and state regulators in the absence of a blanket policy on hydraulic fracturing, according to environmental and energy attorneys....
