Amended Complaint Filed Over Ditropan

Law360 (May 30, 2007, 12:00 AM EDT) -- Less than three weeks after a federal judge threw out an antitrust class action complaint against the maker of the bladder drug Ditropan XL, the plaintiffs filed an amended complaint Tuesday in a San Francisco federal court.

Both complaints accuse the makers and distributors of Ditropan XL of illegally trying to keep generic versions off the market by suing and entering into anti-competitive agreements with potential competitors.

But the new complaint contains some changes, including a second defendant, Ortho-McNeil Pharmaceuticals Inc.—the company that distributes Ditropan XL...
