Crab Shack Chain Pinches Wendy's With Trademark Suit

Law360, Los Angeles (July 14, 2011, 7:27 PM EDT) -- Seafood chain Pincher's Crab Shack slammed Wendy’s International Inc. with a 15-count suit in Florida on Tuesday alleging federal and state trademark infringement, unfair competition and other violations over the burger giant’s use of the tagline “You Can’t Fake Fresh.”

“We have a saying that is repeated often at Pinchers — You Can't Fake Fresh,” said a website advertising Pincher's seven Florida locations. “It's more than a tagline. It's our core value. Fresh is everything to a seafood restaurant, especially ours.”
