Texas Refineries To Get New Emission Permits: EPA

Law360, New York (July 13, 2011, 4:10 PM EDT) -- Texas refineries that received permits under a challenged state program have reached an agreement with the U.S. Environmental Protection Agency to apply for new permits that comply with the Clean Air Act, the regulator announced Tuesday.

The EPA said 136 Texas refineries that have permits under the state's defunct "flexible" permit program, which determined emissions on a plantwide basis rather than individual pollution sources, have agreed to apply for the CAA-compliant permits.

Despite the agreement, Texas and the EPA are still locked in a legal battle...
