DC Circ. Gives Pilots Pension Win In 11-Year Case

Law360, Los Angeles (July 15, 2011, 4:45 PM EDT) -- The D.C. Circuit on Friday reversed a district court decision and held that U.S. Airways Group Inc. unreasonably delayed paying out lump-sum pensions to two retired pilots, entitling them to 45 days' worth of interest on their retirement payouts.

“U.S. Air’s 45-day delay in paying plaintiffs was unrelated to the calculation of plaintiffs’ benefits, and therefore not reasonable under existing [Internal Revenue Service] regulations,” Circuit Judge Janice Rogers Brown wrote in the controlling decision. “We therefore remand to the district court to calculate the appropriate amount...
