Crocs Wins ITC Exclusion Order On Infringing Shoes

Law360, New York (July 18, 2011, 4:00 PM EDT) -- The U.S. International Trade Commission on Friday issued a general exclusion order barring the importation of shoes that infringe Crocs Inc.'s utility and design patents, handing the shoemaker a final victory in a lengthy patent battle with competitors.

The ITC handed down the exclusion order as a remedy after finding in April that Crocs' patents were enforceable, and that respondents Effervescent Inc., Holey Soles Holdings Ltd. and Double Diamond Distribution Ltd. had violated Section 337 of the Tariff Act of 1930 by importing to the U.S....
