Vegetarians Can Claim Injury Over Meat Samosas: Court

Law360, New York (July 19, 2011, 5:22 PM EDT) -- A New Jersey state appeals court revived a suit Monday accusing a local Indian restaurant of breach of warranty and product liability, alleging it inflicted spiritual injuries on Hindu vegetarians by filling their order for vegetarian samosas with meat appetizers.

The appeals court revived the 15 plaintiffs' claim for breach of express warranty against Moghul Express & Catering Co. but affirmed the dismissal of product liability, breach of implied warranty, Consumer Fraud Act and negligence claims.
