Breitbart Says Sherrod Video Is Protected Speech

Law360, Washington (July 19, 2011, 6:15 PM EDT) -- Attorneys for blogger Andrew Breitbart asked a Washington federal judge Tuesday to toss U.S. Department of Agriculture official Shirley Sherrod's defamation and loss of employment suit over a doctored video Breitbart posted of her appearing to make racist remarks.

Sherrod alleges that Breitbart's posting of the video, along with his blog comments suggesting she was a racist, caused her to lose her job with the USDA and harmed her reputation irreparably.
