N.Y. Hospital Closings Unconstitutional, Lawyers Say

Law360 (June 1, 2007, 12:00 AM EDT) -- New York Lawyers for the Public Interest and Chadbourne & Parke LLP argued Friday that New York violated the state constitution by allowing appointed members of a commission to close eight hospitals and downsize dozens of others statewide.

At a hearing before a five-judge panel of the New York State Supreme Court's Appellate division, the attorneys accused the government of violating a section of the constitution that says policymaking must be done by elected representatives.
