9th Circ. Shuts Down Calif. Inmate Care Antitrust Suit

Law360, New York (July 25, 2011, 1:42 PM EDT) -- The Ninth Circuit on Friday rejected Colonial Medical Group Inc.'s bid to revive its antitrust suit accusing a rival medical group and a hospital of stifling competition in the market for providing health care to prison inmates in central California.

A three-judge panel of the appeals court upheld a lower court's conclusion that Colonial had defined the market at issue too narrowly, and upheld the dismissal of Colonial's Sherman Act and Cartwright Act claims against Catholic Healthcare West, which does business as Mercy Hospital; Golden Empire...
