Wash., SC Sue NRC To Force Yucca Nuclear Decision

Law360, New York (July 29, 2011, 5:59 PM EDT) -- South Carolina and Washington state asked the D.C. Circuit on Friday to force the U.S. Nuclear Regulatory Commission to consider an application for a nuclear waste repository at Nevada's Yucca Mountain following the Obama administration's decision to kill the project.

The states, along with individual officials, the National Association of Regulatory Utility Commissioners, and counties in Nevada and South Carolina are asking the D.C. Circuit to mandate that the NRC approve or reject the project, which they claim it should have done by June 3....
