Fed. Circ. Vacates Rejection Of NTP Email Patents

Law360, New York (August 1, 2011, 3:59 PM EDT) -- The Federal Circuit ruled Monday that the rejection of seven NTP Inc. patents for a system of sending email to mobile devices — which the company has asserted in infringement suits against Google Inc. and others — must be reconsidered.

Ruling that the U.S. Patent and Trademark Office's Board of Patent Appeals and Interference used an "unreasonably broad" construction of a key term when it invalidated the patents, the court vacated that decision and sent the matter back to the board for further proceedings.
