Food Co. Ends Insurance Fight Over Pom False Ad Suit

Law360, New York (August 2, 2011, 5:15 PM EDT) -- Fresherized Foods Inc. settled a dispute Tuesday in California seeking to recoup from Continental Casualty Co. the costs of defending and settling a suit claiming Fresherized used Pom Wonderful LLC's advertising concept to market pomegranate juice.

U.S. District Judge Bernard Zimmerman dismissed the action with prejudice, noting that Fresherized Foods and Continental Casualty had settled the dispute, which sought roughly $1 million, prejudgment interest, court costs and attorneys' fees.
