US Seeks To Dismiss NY's Suit Over Gas Drilling

Law360, New York (August 2, 2011, 6:54 PM EDT) -- The federal government said Monday it would move to dismiss New York state's suit seeking to force an environmental impact study of proposed natural gas drilling in the Delaware River Basin, claiming it did not put forth the regulations at issue.

U.S. Attorney Loretta E. Lynch asked U.S. District Judge Nicholas G. Garaufis for a premotion conference on a planned motion to dismiss New York Attorney General Eric T. Schneiderman's complaint for lack of subject matter jurisdiction.
