Lloyd's Underwriter Can't Toss Beef Recall Coverage Suit

Law360, New York (August 3, 2011, 1:20 PM EDT) -- A Lloyd’s of London underwriter on Tuesday lost its bid in California federal court to dismiss a suit by Ruiz Food Products Inc. seeking coverage for costs and damages from the 2010 recall of a Mexican-style beef product.

U.S. District Judge Oliver W. Wanger disagreed with Catlin Syndicate Ltd. that Ruiz’s complaint should be tossed because it failed to plead a condition precedent to insurance coverage under the contamination policy at issue.
