Cell-Tek To Settle Junk Fax Fight For $1.8M

Law360, New York (August 3, 2011, 3:06 PM EDT) -- A consumer plaintiff asked a Massachusetts federal judge on Monday for final approval to settle for $1.8 million a class action claiming Cell-Tek LLC violated Telephone Consumer Protection Act by faxing unwelcome advertisements.

The deal, which also seeks more than $617,000 in attorneys' fees, comes after two years of hard-fought negotiations between class counsel and Cell-Tek, a Maryland-based company that makes and sells geosynthetic products for green buildings, according to the plaintiff's bid for final approval of the settlement.
