5th Circ. OKs Texas Highway Over Enviros' Objections

Law360, New York (August 4, 2011, 6:13 PM EDT) -- The Fifth Circuit on Tuesday approved the construction of a 15-mile segment of a Houston ring road, overruling environmentalists' objections that the federal government had not sufficiently reviewed the highway plan before approving it.

A three-judge panel said that the Federal Highway Administration did not violate environmental law when it approved the construction of the so-called Segment E of Texas State Highway 99, a planned 180-mile beltway that would encircle Houston.
