DHL Dodges Delivery Driver Overtime Action

Law360, New York (August 5, 2011, 5:19 PM EDT) -- An Alabama federal judge on Friday handed DHL Express (USA) Inc. victory in an overtime pay collective action, finding that the delivery company was not the employer under federal law of drivers who worked for a contractor.

U.S. District Judge Virginia Emerson Hopkins granted summary judgment to DHL in the suit, brought by a delivery driver who worked for contractor Territory Reps Inc. providing local pick-up and delivery services to a DHL facility in Birmingham, Ala.
