Law360, New York (August 10, 2011, 4:23 PM EDT) -- An Illinois federal judge on Wednesday overruled a jury verdict that Whirlpool Corp. violated a state false advertising law in marketing its steam dryers, a decision that destroys any claim to victory for plaintiff LG Electronics USA Inc. in the unfair competition suit.
U.S. District Judge Amy J. St. Eve ruled that Whirlpool's disputed advertising did not occur “primarily or substantially” in Illinois, a necessary condition for a claim under state false advertising law to succeed.
