GSK Wins False Patent Marking Suit Over Citrucel

Law360, New York (August 11, 2011, 2:37 PM EDT) -- GlaxoSmithKline PLC on Wednesday prevailed in a suit alleging it falsely marked the laxative Citrucel with expired patents, with a New York federal judge ruling following a bench trial that there was no evidence the company knew the patents were expired or intended to deceive the public.

U.S. District Judge Richard M. Berman issued his conclusions based on evidence presented at a bench trial in June and found that plaintiff Public Patent Foundation Inc. failed to show that anyone at GlaxoSmithKline knew when the patents expired....
