Drilling Co. Can't Force Execs To Arbitrate: 5th Circ.

Law360, New York (August 11, 2011, 4:30 PM EDT) -- The Fifth Circuit ruled Wednesday that offshore drilling services company Aban Offshore Ltd. could not compel two Beacon Maritime Inc. executives to enter arbitration in a contract dispute, saying the two men were not personally bound by Beacon's agreement.

Beacon signed a contract in September 2005 to refurbish Aban's oil rig, but a dispute arose regarding Beacon's performance of the job, and Aban initiated arbitration against Beacon and Guy Covington and Russell Covington, Beacon's vice president of sales and president, respectively, according to the precedential opinion....
